Terms of Service

1. Acceptance of these Terms

By creating a TrailPassport account, or by continuing to use TrailPassport after these Terms change, you agree to be bound by them. If you do not agree to these Terms, you must not create an account or use the TrailPassport application and services.

2. What TrailPassport Is

TrailPassport is a digital hiking-achievement tracker and gamification tool. It allows you to log completions of Trail Items (Peaks, Ways, Scrambles, and Endurance Walks), earn dynamic points, collect country flags, and progress through Travel Status tiers.

Points, flags, and completions are historical records based strictly on information submitted by you. TrailPassport does not verify your completions in the field, nor does it provide physical navigation, real-time tracking, or safety services.

3. Eligibility and Your Account

Age Requirement: You must be at least 18 years of age to create an account and use TrailPassport. By registering, you represent and warrant that you are 18 years of age or older.

Account Security: You must provide a valid email address and keep your login credentials secure. You are solely responsible for all activity that occurs under your account. You must notify us immediately through the in-app Feedback form if you suspect any unauthorized access to or use of your account.

4. Intellectual Property Rights & Open Data

Our Proprietary Intellectual Property: All rights, title, and interest in and to TrailPassport—including the application software, source code, visual design, brand identity, user interface, custom descriptions, curated characteristics, difficulty scoring models, dynamic point calculation algorithms, trophy badges, and tier systems—are and remain the exclusive property of TrailPassport (or its licensors).

Third-Party & Open-Source Data: TrailPassport utilizes open-source and public-domain data for certain Peak, Way, Scramble, and Endurance Walk geographical coordinates, elevation, prominence, names, distances and routes. TrailPassport claims no copyright or proprietary ownership over such underlying public-domain or open-source datasets themselves. However, any original text descriptions, custom classifications, additional data attributes, layout, formatting, and compilations added to or created around that data by TrailPassport remain our sole intellectual property.

Restrictions: Except as expressly permitted in these Terms, you may not copy, modify, distribute, sell, lease, reverse engineer, or extract source code or proprietary dataset compilations from any part of TrailPassport.

5. Content You Submit

Feedback submissions, including text and uploaded screenshots submitted through our Feedback form, are used by us to diagnose issues and improve the platform. You retain ownership of any content you submit; however, you grant TrailPassport a non-exclusive, worldwide, royalty-free license to use, reproduce, and process such feedback for the purpose of operating, maintaining, and improving the app.

6. Acceptable Use

You agree not to misuse TrailPassport. Specifically, you agree that you will not:

  • Submit false or fraudulent activity completions or intentionally manipulate the points economy;
  • Scrape, crawl, or automatedly extract data or curated compilations from the platform;
  • Attempt to access, tamper with, or use non-public areas of the platform or another user's ("Wayfarer's") account;
  • Upload content that is unlawful, defamatory, harassing, infringing on third-party intellectual property, or containing personal data of others without their explicit consent;
  • Disable, avoid, or circumvent any security measures or usage limitations of the app.

We reserve the right to suspend or permanently terminate any account that violates this section, at our reasonable discretion.

7. Points, Tiers, and Future Paid Features

Gamification Rules: The points formula, Trophy Tier bonuses, and Travel Status thresholds may change over time as the platform evolves. Consistent with our grandfathering commitment, changes will never retroactively alter points you have already earned and had stamped onto your account.

Future Paid Tiers & Subscriptions: TrailPassport may introduce paid premium features, subscriptions, or digital tiers ("Paid Services"). All Paid Services will be governed by these Terms and any specific purchase terms presented at the time of purchase. If you purchase Paid Services as a consumer residing in Ireland or the European Union, you acknowledge your statutory right to cancel within 14 days under EU/Irish Consumer Rights law, provided that performance of digital services has not commenced with your prior consent.

8. Physical Safety Disclaimer & Assumption of Risk

PLEASE READ THIS SECTION CAREFULLY.

Not a Navigation or Safety Tool: TrailPassport is strictly a personal record-keeping and gamification platform. It is not a safety, navigation, GPS tracking, emergency, or route-planning product. Difficulty ratings, isolation ratings, and point values are for gamification purposes only and must not be relied upon for safety or navigation.

Assumption of Risk: Outdoor activities (including hiking, scrambles, hill walking, mountaineering, and endurance walks) carry inherent risks of severe physical injury, illness, disability, property damage, or death. You voluntarily assume full responsibility for all risks associated with any physical activity you undertake in connection with your use of TrailPassport.

Personal Responsibility: You are solely responsible for evaluating your own physical fitness, weather conditions, terrain, equipment, navigation (using official paper maps or dedicated navigational devices), and overall trip safety.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

"As-Is" Provision: TrailPassport is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Exclusion of Damages: TrailPassport, its founder(s), and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the app.

Financial Liability Cap: To the extent permitted by law, TrailPassport's total aggregate financial liability to you for all claims arising out of or relating to the use of the app shall not exceed the greater of €50.00 or the total amount paid by you to TrailPassport in the twelve (12) months preceding the claim.

Statutory Exceptions: Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under the laws of Ireland.

10. Third-Party Infrastructure & Availability

TrailPassport relies on third-party infrastructure (including cloud hosting, database management, and third-party map tile providers) that carry no uptime guarantees to us. While we aim for high platform availability, we do not guarantee uninterrupted, secure, or error-free access to the app.

11. Account Termination and Deletion

You may delete your account at any time via Profile Settings in the app. Upon deletion, your right to access the app and any accumulated points or badges will cease. We reserve the right to suspend or terminate accounts that breach these Terms. Please refer to our Privacy Policy for information on how your data is handled upon deletion.

12. Governing Law and Dispute Resolution

These Terms, their subject matter, and their formation are governed by and construed in accordance with the laws of Ireland.

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of TrailPassport shall be submitted to the exclusive jurisdiction of the Courts of Ireland, without prejudice to any mandatory consumer rights you have under local law to bring proceedings in your country of residence within the EU.

13. Changes to these Terms

We may update these Terms from time to time. When updates occur, the version number and effective date at the top of this page will change. Users who have an existing account will be notified and asked to review and re-accept the updated Terms before continuing to use TrailPassport.
